Terms & Privacy Policy

1. Who we are
Micah Farm ("we", "us", "our") sells the Spring Blessing Pot, a hand-potted strawberry plant gift, from Magaliesburg, Gauteng, South Africa. You can reach us at malinda@khabula.com or via WhatsApp (link in the footer).
2. What you're buying
The Spring Blessing Pot is a living plant, hand-potted to order in small batches — not a mass-produced, shelf-stable item. Natural variation between pots (size, exact flower colours, leaf shape) is normal and expected, not a defect.
3. Prices and payment
- All prices are in South African Rand (ZAR) and include the item price; courier delivery carries an additional fee, shown clearly before you pay.
- Payment is processed securely by Yoco. We never see or store your card details.
- Your order is only confirmed once payment has actually cleared — reaching our payment page, or seeing a "processing" screen, is not confirmation. We rely on Yoco's server-to-server confirmation, not just what your browser shows, specifically so that a browser closing early or a payment that fails after the fact never gets treated as a completed sale. You'll receive an email the moment payment is genuinely confirmed.
4. Order preparation and fulfilment
- We pot and pack orders in batches on fixed days (currently Thursdays and Saturdays), not on demand — your confirmation email tells you which batch your order falls into.
- You choose how to receive your order at checkout: collection at The Roadhouse (Fridays), Galloway Gardens Market (dates confirmed by us in advance), collection at Micah Farm (Saturdays), or courier delivery anywhere in South Africa.
- Dates we give you are our honest best estimate based on our batch schedule and, for courier, typical transit times — they are estimates, not guaranteed delivery dates, since transit ultimately depends on the courier.
- If something changes on our side (for example, a delay to when fresh stock arrives), we will email you directly, and where relevant, follow up by WhatsApp.
5. Collection and courier delivery
- Roadhouse collection is a bulk hand-off: we deliver the batch to a single Roadhouse representative, who signs for receipt of the batch. Each pot is individually labelled with the buyer's name.
- Farm and market collection require confirming receipt in person at the time of collection.
- Courier delivery is handled via a third-party courier aggregator. Once a parcel has been handed to the courier, transit time and handling are the courier's responsibility; we will assist with any query but cannot control courier-side delays.
- Risk in the goods (e.g. damage in transit) passes to you once the item is handed to you, your nominated collection point, or the courier, whichever applies to your chosen method.
6. Cancellations, returns and refunds
Because the Spring Blessing Pot is a perishable, made-to-order living item, it cannot be resold once potted. Accordingly:
- We are unable to offer a change-of-mind refund or exchange once an order has entered a batch.
- If your order arrives damaged, or is materially not as described, please contact us within 24 hours of collection/delivery with a photo, and we will arrange a replacement or refund at our discretion.
- If we are unable to fulfil your order at all (e.g. crop failure), you will receive a full refund to your original payment method.
- Nothing here limits any right you have under the Consumer Protection Act 68 of 2008 that cannot lawfully be excluded.
7. Limitation of liability
To the fullest extent permitted by law, our liability to you is limited to the amount you paid for the relevant order. We are not liable for indirect or consequential loss.
8. Protection of Personal Information (POPIA)
We process your personal information in accordance with the Protection of Personal Information Act 4 of 2013 (POPIA).
What we collect
- Name, email address, and cell phone number (all orders)
- Delivery address (courier orders only)
- Payment is handled entirely by Yoco — we never receive or store your card number
Why we collect it
- To process and fulfil your order, contact you about it, and issue your invoice
- To book courier collection where applicable
- To notify you of changes affecting your order (e.g. a restock delay)
The lawful basis for this processing is performance of the contract you enter into with us when you place an order.
Who we share it with
- Yoco (payment processing) — receives what's needed to process your payment
- Bobgo and the courier they book (The Courier Guy, RAM, etc.) — receives your name, phone, and delivery address, courier orders only
- Zoho Books — receives your name and email to generate and send your invoice
We do not sell or rent your personal information to anyone.
How long we keep it
We retain order records (including the personal information tied to them) for as long as required for accounting, tax, and warranty purposes under South African law.
Your rights
You have the right to request access to, correction of, or deletion of your personal information, and to object to our processing of it, subject to our legal obligations (e.g. we can't delete records we're required to keep for tax purposes). To exercise these rights, email malinda@khabula.com.
You also have the right to lodge a complaint with the Information Regulator of South Africa (inforegulator.org.za) if you believe your information has been mishandled.
